Terms and Conditions for JobMate

Welcome to JobMate!

These Terms of Service ("Terms") govern your use of the JobMate website at https://jobmate.top ("Website"), browser extension, and job search tracking service (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Description of JobMate

JobMate is an intelligent job search companion that helps users capture, track, and manage job opportunities through a browser extension and AI-enhanced dashboard. Our Service includes:

- Browser extension for one-click job capture from major job boards
- Dashboard for organizing jobs through a visual Kanban pipeline
- AI-powered company insights and personal fit scores (Pro plan)
- Smart reminders for follow-ups and interviews
- AI writing assistant for cover letters and emails (Pro plan)
- Data export in CSV/JSON formats
- Optional sync with GitHub and iCloud (Pro plan)

2. Eligibility

You must be at least 16 years old to use JobMate. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

Account creation is optional. You can use JobMate's core features without an account, with data stored locally on your device. Creating an account allows you to:

- Access the Service from multiple devices
- Enable optional cloud sync features
- Purchase and use Pro plan features

You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access

4. Pricing and Payment

4.1 Free Plan

The Free plan includes:
- Save up to 50 jobs
- Basic Kanban board organization
- Manual company research
- CSV/JSON export
- Local data encryption
- Smart reminders

4.2 Pro Plan

The Pro plan is available for a one-time payment of $29 and includes:
- Unlimited job cards
- AI company snapshots
- Personal fit scores (0-100 match rating)
- AI writing assistant
- Notion integration
- Priority support

4.3 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to provide accurate payment information and authorize us to charge your payment method.

4.4 Refund Policy

We offer a full refund within 7 days of your Pro plan purchase if you are not satisfied. To request a refund, contact us at bartzalewskidev@gmail.com with your order details.

Refunds are processed within 5-10 business days to your original payment method. After 7 days, all sales are final.

5. License and Restrictions

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal job search purposes.

5.2 Restrictions

You may NOT:
- Resell, redistribute, or sublicense access to the Service
- Use the Service for any commercial recruiting or staffing purposes
- Attempt to reverse engineer, decompile, or extract source code
- Use automated tools to scrape or extract data from job boards through our extension
- Share your account credentials with others
- Use the Service to violate any applicable laws or regulations
- Circumvent any technical limitations or access controls
- Remove or modify any proprietary notices or labels

6. User Content and Data

6.1 Your Data

You retain all rights to the data you create, store, and manage through JobMate, including:
- Saved job listings and notes
- Resume/CV uploads
- Personal customizations and tags

6.2 Local Storage

By default, your job search data is stored locally on your device with AES-256 encryption. We do not access, use, or claim ownership of your locally stored data.

6.3 Data Export

You can export your data at any time in CSV or JSON format. This ensures you maintain full control and portability of your information.

7. AI Features and Third-Party Services

7.1 AI Processing

When using AI features, you choose between:
- Local AI: Processing on your device (completely private)
- Cloud AI: Using your own OpenAI API key (data sent directly to OpenAI)

By using AI features with your own API key, you acknowledge that requests are sent to OpenAI and are subject to OpenAI's terms and privacy policy.

7.2 Third-Party Integrations

JobMate integrates with third-party services including:
- Job boards (LinkedIn, JustJoin.it, NoFluffJobs, etc.)
- Notion (optional, Pro plan)
- GitHub and iCloud (optional sync)
- OpenAI (when you use your own API key)

Your use of these integrations is subject to their respective terms of service.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy at https://jobmate.top/privacy-policy, which is incorporated into these Terms by reference.

9. Intellectual Property

9.1 Our Property

The Service, including all software, designs, text, graphics, logos, and other content (excluding user content), is owned by JobMate and protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"JobMate" and our logos are trademarks of JobMate. You may not use our trademarks without our prior written permission.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Job data extracted by our extension will be 100% accurate
- AI-generated insights, fit scores, or content will be accurate or reliable
- The Service will meet your specific requirements

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10.3 Job Search Outcomes

JobMate is a tool to help organize and manage your job search. We do not guarantee any specific outcomes, including job offers, interviews, or employment opportunities.

11. Termination

11.1 By You

You may stop using the Service at any time. To delete your account, contact us at bartzalewskidev@gmail.com.

11.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we deem harmful to other users or the Service.

11.3 Effect of Termination

Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account data (excluding locally stored data on your device)
- You remain liable for any outstanding payments
- Sections of these Terms that by their nature should survive (including disclaimers, limitations of liability, and dispute resolution) will continue to apply

12. Changes to the Service and Terms

12.1 Service Changes

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that negatively impact your use.

12.2 Terms Updates

We may update these Terms from time to time. We will notify users of material changes via email or prominent notice on the Website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:
1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration in Poland
3. Each party bears its own costs unless otherwise determined by the arbitrator

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobMate regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
